This is a bill to specifically attack the owners of hounds, under this law, if your dogs chases a rabbit - in your own backyard, in a fenced dog park - whatever, you could be guilty of a CRIME
The law was formulated in response to the sport of Open Field Coursing, but the activists did not stop there, they decided to try and make a law where they could attack having any normal dog..........
ie; the upshot of this law if it is passed is that it WILL be used by the nutcases to attack keeping any companion animal that chases anything - the writing is on the wall - you should see some of the gloating emails the animal left have sent people having sight hounds (what is next? Outlawing cats chasing mice? - wait I forgot, most 'ethical animal rights' groups would destroy all domestic animals so why am I surprised )
For those that think this impossible consider this - show a even chihuahua a running rabbit and it will chase - doesn't matter if you are running your dog at a dog park. The owner could be charged with a crime if it does not try and stop the little mite (if the animal chases and you do not stop them, well you are doing it knowingly now aren't you). When formulators of the bill were asked to address these problems or even respond intelligently they responded rudely and did not argue that they were formulating something to attack dogs in general. They even spliced footage in from Spain to a "tell all" video report showing animals being mauled - that had nothing to do with what really happens in OFC OR to do with their law which attacks chasing many things.
Here are some important points;
***AB 2100 creates a new crime of ANIMAL CRUELTY based on currently lawful
hunting. The debate likely will not be about regulating hunting or hunting terms; rather, the debate will be about CRUELTY and prohibition and punishment.
***Hunting is protected by the Constitution and Constitutional Amendment in
the State of California and regulated by the Department of Fish & Game and
defined in the Fish & Game Code.
***The dogs are not trained to kill. In fact on adverage less than one chase in 30 results in any animal being touched
***The proposal is for 597.4 to be added to the PENAL CODE under Title 14.
MALICIOUS MISCHIEF, between 597.3 which addresses live animal markets and
597.5, which addresses dog fighting!
***From the draft of AB 2110:
SECTION 1. Section 597.4 is added to the Penal Code, to read:
597.4. (a) Any person who knowingly engages in field coursing is guilty
of a misdemeanor punishable by imprisonment in a county jail for a period
not to exceed six months, by a fine not to exceed one thousand dollars
($1,000), or by both that imprisonment and fine.
(b) For the purposes of this section, "field coursing" includes any
activity in which a dog is left untethered and allowed to track and pursue
any rabbit, hare, or fox and that results in the injury or death of the
rabbit, hare, or fox.
***What that means is – if your dogs takes a jackrabbit or a fox in your own
land, you can go to jail! And it's a misdemeanor!
People with hounds might end up charged or convicted of animal cruelty for
something other than open field coursing -- for instance, running your dog
on your own acreage where rabbits, hare or foxes are present. "Left
untethered and allowed to" would cover just about anything short of secure
confinement (picture those locked, topped runs with the sides embedded in
concrete) because there may no practical way to stop the runaway hound.
If AB 2110 becomes law, one would be charged with a misdemeanor. Counsel has advised that a misdemeanor is bad enough but the animal cruelty designation is a special kind of enhancement with very bad consequences. It is likely to meet the threshold for "moral turpitude" for professional licenses such as attorneys or teachers; and cause for suspension by the AKC, and a bar to permits, licenses and most employment involving animals.
